Which is ironic because non-police citizens are held to a far lower standard of use of deadly force. No department policies apply to non-police. No limits on state authority, hell in my state you can sue the PD for use of deadly force, but non-police have lawsuit shielding. We're not subject to review boards or insurance requirements either. So my test of a reasonable situation is 'Would legal concealed carrier ME 'get away' with what I had to do? no? Then for sure the PD can't get away with it. If unrestricted me is held accountable, then they have to be.

How can non-police use of force be more restricted than police use of force? For one, no non-officer, at least in my state, is subject to local police department employment policies, not subject to union protections, not compelled to testify, and their firearm/ammo choices are not mandated. In my state, officers have no protection against civil suit other than sovereign immunity, whereas a person using deadly force now has immunity from all civil suit in a self-defense case, it's ruled justified you can't even try to sue the shooter, meanwhile big city PDs are paying out millions for police shootings.

The method is proscribed by law. In my state for example, a deadly weapon is defined as a firearm, a knife, a sap, a baton, and so on. Using any of those is equal use of deadly force under the law. I have a gun, you pull a knife, equal confrontation. I have a knife and you extend a baton, to the law it's like we both have machine guns. And a state ccw permit allows the carrying of all of those. Just using deadly force doesn't mean someone dies. Just pulling a gun and that making some assailant flee is a use of deadly force.

My personal litmus test is this: As a non-police citizen, I'm subject to LESS regulation and policy in the use of deadly force to defend my life, so my question is always "Would I 'get away' with what the PD did in whatever situation? If the answer is no, then damn sure they, held to a higher standard and trained to KNOW BETTER, shouldn't. Qualification and training is always a bad excuse to me, because if you're trained and qualified, it means YOU KNEW BETTER.
