@cerebrophage7709 Incorrectly identifying a victim as an assailant is one way to catch a homicide charge. You aren't supposed to "take out" anyone who is not posing an "immediate" threat. If Kyle were an "active shooter" he had a target rich environment but oddly, only shot people who were in the act of attacking him as he made his way to the police lines.

The assailants intention is irrelevant. True or not, it could not be known by the accused. His ACTIONS gave Kyle reasonable fear for his life.

Working in concert with other rioters to kill Kyle, causing the death of one assailant, is enough to convict the surviving attacker of Felony Murder. It's too bad that justice takes a back seat to politics.

He was indeed rushing to the cries of "medic" until he decided to turn around (abandoning the medic role) and chase Kyle with a drawn Glock.

Had the police not abandoned part of the city to its fate, none of these events would have happened. (orders from the top, however political, are still orders though.) If anyone is responsible, it is the Mayor.

@cerebrophage7709 It's illegal to shoot someone running away as they do not pose a threat. No double standard. When surrounded by assailants, running may save your life and is preferred to "going Rambo" no double standard. Running toward the authorities through a threatening mob is not an act of aggression. No double standard. Kid? Do YOU remember where you were when JFK was shot? I saw Sputnik with my own eyes.

@cerebrophage7709 I would prefer that they did not. Who in this specific event were police? The assailants, or the victim of assault? I would NEVER want the police to shoot someone who is running TO the police with his hands up. I'd also be unhappy if he were beaten with a skateboard by an uninvolved stranger while running TO the police. Save your silly false equivalencies for your comrades.

Kyle did not belong there at all. His youth made him a target for predators and he did not understand that. Kyle was looking to be "part of the event". Now he always will be. He is guilty of being a fool, but not of murder. Like so many adrenalin junkies and cop wannabes, he'll never be employed by any city. He doesn't deserve a murder charge for putting himself foolishly in danger.

Active shooters are actively shooting. A mugging victim who shot his attacker is not an active shooter. "See that dead guy over there? Don't be like him. Let the kid get to the police."

If it can be shown that the surviving attacker was acting in concert with the others attempting to murder Kyle, he should be tried for the felony murder of the other two assailants.

If someone tries to mug you and you shoot him and then try to contact the police, it does not make you an "active shooter". The only people shot were "active assailants". Every-single-one-of-them would have been unharmed if they had just left well enough alone.

@LandSharkEatsU Yes. And if he is found guilty there was a "murder." If the jury determines it was self defense then It's "justifiable homicide". Because the jury has not yet decided, it is a homicide trial. The Judge rightly struck the word "murdered' from testimony already as incorrect and prejudicial. As of this moment, there has not been a "murder" only homicide ( justifiable or not) involved in the case. Although I expect the term to be used in closing arguments.

@LandSharkEatsU So the guy throwing things at him and chasing him with threats is not a bother. Got it. He just ran away using his tractor beam to pull a bystander into chasing him at speed until Kyle got him where he wanted him, a place where Kyle was cornered and could retreat no farther. That's one really sophisticated and complicated to shoot someone when it'd be easier to just point and shoot; and there was no evidence of a tractor beam being used.

@Everynamestaken69 I knew a guy who was 5'4" and in Special Forces who was no "manlet". A slightly taller fat child is no comparison. Rosenbaum sought a victim who he correctly thought weak. He certainly had no chance against one of the armed adults.

His "intent" could not be known to Kyle, only his actions, so his intent is irrelevant. Only did he give Kyle reason to fear bodily harm.
